INDIANAPOLIS — The election challenge brought forward against U.S. Rep. Jim Banks (R-Ind., District 3), a Republican candidate for Indiana’s U.S. Senate seat, has been withdrawn.
According to documents from the Indiana Election Division, obtained by FOX59/CBS4, an Indianapolis man withdrew his challenge against Banks in relation to his placement on the 2024 Republican primary election ballot. The original challenge was listed as Weingarten v. Banks on the Indiana Election Division public notice of the meeting surrounding the challenges.
Weingarten, an Indianapolis resident, previously challenged Banks, alleging that Banks had not met the threshold requirements of qualified signatures to be eligible for the ballot, according to previous reports.
Banks officially filed earlier this month to run for the U.S. Senate after he first announced his campaign in January 2023. As of Thursday, Banks is expected to face John Rust in the Republican primary.
Several election challenges have been filed against Rust. According to previous reports, the challenges claim that Rust was not eligible for the Republican primary ballot because he violated Indiana election law.
The Indiana Supreme Court previously found that Rust’s placement on the Republican primary ballot could be challenged, overruling a Marion County court ruling that found a portion of the Indiana Election Code that prevented Rust from running as a Republican was unconstitutional.
