Denver’s Regional Transporation District is facing a lawsuit after a commuter train crashed into and killed a bicyclist last year.

The lawsuit was filed Thursday by Jacqueline Flores Razo after her husband, Juan, was killed in a crash with an RTD A-Line train last July.

According to the complaint, Flores Razo’s husband was riding his bike through the crosswalk of RTD’s Havana Crossing light rail station when a southbound train turned off its lights for a northbound train.

Once the northbound train passed, the southbound train continued through the station and crashed into Juan.

“The incident was caused by the negligent, careless and reckless operation of the RTD train,” the lawsuit stated, adding that the train conductor “failed to exercise caution and due care by, among other items, failing to be attentive and properly monitor the train tracks.”

The lawsuit claims that the RTD train conductor committed vehicular homicide, reckless driving and careless driving.
