The May 5 letter “ABA doesn’t get to choose judges” argues that the Constitution doesn’t mention the American Bar Association. I don’t have to reread the Constitution to know that it doesn’t mention any organizations.
However, I am sure tens of millions of people feel that there is no better group to pass judgment on the qualifications of judicial nominees. In fact, all major organizations issue statements regarding any legislation or nominees that concern them.
The letter claims that Judge Kathryn Kimball Mizelle was found qualified by the Senate, but most senators, unless they are lawyers, are not qualified to judge such nominees.
In addition, Republican senators are not allowed to use their judgment on anything. They must do what former President Donald Trump wants them to do, even if they disagree with him.
Even today, with Trump out of office, he still controls almost all Republicans in Congress.
I downloaded and read Mizelle’s 59-page report voiding the federal mask mandate for airplanes and other modes of public transportation. It was difficult to follow, so it would be difficult to defend her decision.
We can see the folly of Trump’s judicial nominees in the disaster that the Supreme Court has become.
