The Nevada Democratic Party has amended its lawsuit seeking to keep the Green Party off the general election ballot, arguing the minor party’s petition contained the wrong affidavit language.

In a Wednesday letter to the attorney general’s office, a lawyer representing Nevada Democrats asked for the approval of the Green Party’s ballot access to be rescinded.

The Green Party’s petition appeared to use the affidavit language for initiative petitions, not minor parties, which omits a sentence stating the circulator believes all signees were registered voters in the county they reside.

However, the affidavit language used by the party is the same as that recommended by the Nevada Secretary of State’s Office in its guide for minor political parties to qualify for the ballot.

Green Party officials did not respond to a request for comment. A spokesperson for the secretary of state’s office declined to comment because the lawsuit is ongoing.
