SIOUX FALLS, S.D. (KELO) — The NCAA is trying to get South Dakota’s lawsuit moved to federal court.  

Attorney General Marty Jackley announced the suit last month. The lawsuit seeks to stop a proposed $2.8 billion settlement the NCAA and its largest conferences struck earlier this year in three class action lawsuits. Jackley feels the deal would unfairly burden South Dakota’s Division I universities.

The lawsuit was first filed in South Dakota Circuit Court in Brookings County.

Jackley says the settlement deals with new rules that allow student-athletes to profit from their fame. He believes because of the settlement, South Dakota athletes would allegedly get significantly less.

According to a statement to KELOLAND News, even if the case is moved to federal court, Jackley is confident that federal authorities will not be any more impressed by the NCAA’s treatment of smaller universities and women. 

“If the NCAA is looking for a fight, we are happy to provide one because this is an issue about fairness and equality,” Jackely said.
