MUNCIE, Ind. — An Albany, Indiana, man allegedly drove a car occupied by children while he was intoxicated.

According to court documents released Tuesday, police first became aware of 28-year-old Tyrone Louis Hederington’s activity when they were called to the 2600 block of West Godman Avenue around 10:56 p.m. Monday.

Officers were dispatched to the area in reference to a domestic violence incident. When police arrived at the scene, they spoke with two individuals who claimed Hederington punched their heads with a closed fist.

Court records indicate the alleged victims told police Hederington became frustrated while they were looking for a lost cell phone. He then allegedly instigated a fight that broke out between himself, the victims and one other individual.

One of the victims indicated he tried not to fight Hederington because Hederington had a gun on his side. The victim told police Hederington did not threaten to use the firearm during the incident.

After the fight, Hederington and the other individual involved in the fight left the scene in a Honda Accord, leaving the victims behind. When he left the area, Hederington took two children with him.

Per court documents, the victims told police Hederington was intoxicated.

Police eventually located Hederington and the Accord and conducted a traffic stop. A portable breath test was subsequently conducted with Hederington. The sample he provided indicated his BrAC was .112.

Upon further investigation of Hederington’s records, law enforcement determined he was driving with a suspended license.

Hederington was transported to the Delaware County Justice Center after the incident. He has been preliminarily charged with neglect of a dependent, operating while intoxicated causing endangerment of a person, battery and driving while suspended.

The only felony charge Hederington faces is neglect of dependent. Neglect of a dependent is a Level 6 Felony in Indiana. The maximum penalty for such a crime is a 2.5-year prison sentence and a fine of up to $10,000.
