The Arizona Attorney General has joined a coalition of 22 states in filing a lawsuit against the U.S. Department of Agriculture (USDA). The lawsuit aims to stop the USDA’s recent guidance, which attempts to make nutritional assistance for children dependent on the adoption of ridiculous school bathroom policies.
Arizona joins Alaska, Alabama, Arkansas, Georgia, Indiana, Kansas, Kentucky, Louisiana, Missouri, Mississippi, Montana, Nebraska, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, and West Virginia.
The USDA’s guidance says public schools must allow boys who identify as girls into girls’ bathrooms and showers as a condition of receiving federal funding for lunches, breakfasts, and snacks. The coalition argues the guidance imposes new and unlawful regulatory measures on state agencies and operators receiving federal financial assistance from the USDA. This will result in regulatory chaos and threaten essential nutritional services for some of our most vulnerable students.
The attorneys general are suing the USDA to prevent it from taking away authority that belongs to Congress, representatives of the states, and the people.
