CANTON, S.D. (KELO) — Nineteen-year-old Peyton Roelfsema and Jerry Wallenstein, 68, two Lincoln County men, are facing serious charges in separate incidents.

Both men appeared at their hearing in Canton via video from the Minnehaha County Jail, where they were being held.


Wallenstein of Sioux Falls is charged with vehicular homicide, two counts of DWI, Reckless Driving and Failure to Yield to Left-Turning Vehicles, charges which together carry a total maximum of more than 15 years in prison.

According to a court document filed Wednesday in the case, Wallenstein is accused of killing a pregnant person while driving under the influence.

During the hearing, a Lincoln County State’s Attorney explained that Wallenstein had made a left turn, t-boning a motorcyclist who was declared dead at the scene. Wallenstein was found to be under the influence of marijuana and another unnamed drug, the state’s attorney said, and clarified that no alcohol had been detected.

The state’s attorney described Wallenstein as a risk to public safety, and requested a $5,000 cash-only bond, noting that Wallenstein has no previous record.

Judge Andrew Robertson approved a cash-only bond of $5,000 with the conditions of good behavior, no consumption of alcohol and no consumption of drugs without a prescription. Wallenstein will also be subject to the 24/7 urinary analysis program, and is expected to provide a UA three times per week.


Roelfsema of Harrisburg is charged with two counts of rape, one in the first degree and the other in the second degree for the rape of a 12-year-old.

The state’s attorney explained that Roelfsema is accused of using his fingers to penetrate the 12-year-old victim while in the presence of a 10-year-old.

Roelfsema’s charges carry a maximum sentence of life in prison.

Judge Robertson approved the state’s attorney’s request for a $100,00 cash only bond.

If Roelfsema is able to post bond, he is to have no contact with minors, including the victim and the witness, or with the victim’s mother.

Roelfsema has entered a plea of not guilty.
