FISHERS, Ind. — A Yorktown man is accused of raping an intoxicated teenage girl after giving her a ride home from a party.
Byron M. Pomeroy, 20, faces two counts of rape, a Level 3 felony.
According to court documents, the alleged rape occurred in December of 2022. Pomeroy reportedly gave the girl a ride home from a party in Fishers before raping her in her bedroom.
The 16-year-old girl reportedly could not remember the assault due to being intoxicated but woke up the next morning in pain. A rape kit was conducted at a hospital which confirmed sexual activity had occurred.
Police said Pomeroy eventually admitted to having sex with the girl but claimed she initiated the act. Police noted that Pomeroy lied to police in a previous interview about having sex with the girl. He also did not disclose in prior interviews that he was the one who drove the victim home.
According to the documents, lab test results received by police in October confirmed that Pomeroy’s DNA was found on the victim.
In January, a witness told police that Pomeroy had admitted to them about having sex with the victim after taking her home from the party. The witness said Pomeroy did not share details of the act. The witness did tell police, however, that they did not believe Pomeroy raped the victim based on conversations with him and the fact that the witness had never seen Pomeroy take advantage of intoxicated friends in the past.
Pomeroy was arrested in September of 2022 for driving while intoxicated and crashing at a high rate of speed. A female passenger was in his vehicle at the time and suffered several injuries.
If convicted, Pomeroy could face three to 16 years in prison.
