WASHINGTON – On Thursday, U.S. Sen. Ron Johnson (R-Wis.) delivered remarks on the Senate floor about his motion of disapproval under the Congressional Review Act (CRA) to dissolve a proposed Biden Administration rule that would exacerbate the border crisis by illegally upending the process by which the U.S. government grants asylum claims. 

The rule “Procedures for Credible Fear Screening and Consideration of Asylum, Withholding of Removal, and CAT Protection Claims by Asylum Officers,” will go into effect on May 31, 2022 and allow illegal border crossers claiming asylum to have their asylum application approved by U.S. Citizenship and Immigration Services (USCIS) officials, not immigration judges, and to not be detained while their application is pending.  

In October 2021, Sen. Johnson submitted a public comment in opposition to the rule, calling out the Biden administration’s “blatant violation of the laws passed by Congress.” In April 2022, Sen. Johnson introduced the motion of disapproval, stating in part “The Biden administration is sending a clear message: our borders are open, you will not be kept in custody, and you will not have to see a judge to stay here.”

Following Sen. Johnson’s remarks on Thursday, the joint resolution of disapproval failed to pass. The Senate will hold the vote again and will assert the Biden administration needs to follow the law, not further break it for their disastrous open border policies.
